The appellant, Arthur J. Akins, was driving an automobile in which his wife was killed when the vehicle left the roadway and struck a tree. He was indicted on charges of vehicular homicide, driving under the influence of an intoxicant, and driving on a revoked drivers license. Akins, an elderly man in poor health, entered several guilty pleas including a best interest plea on the vehicular homicide. The trial court accepted the pleas, but at the sentencing hearing refused to accept the sentence recommended by the state on the vehicular homicide charge. Akins withdrew his plea on that charge and the case went to trial. At trial, the jury returned a verdict of guilty. The trial court sentenced appellant to serve four years.
